Terms of Service (General Terms and Conditions of Sale)

1. Purpose These General Terms and Conditions of Sale ("Terms") govern all sales made through naduva.shop between Henry Oware ("we", "the Seller") and any consumer placing an order ("you", "the Customer"). Placing an order confirms that you have read and accepted these Terms.

2. Seller identification Henry Oware, sole trader (entreprise individuelle), SIREN 107 026 619, 8 bis rue Abel, 75012 Paris, France. Contact: naduva.shop@outlook.com.

3. Products Products are described as accurately as possible. Photographs are indicative and are not contractually binding regarding minor variations in colour or presentation. Products are offered while stocks last.

4. Prices Prices are displayed in euros (EUR) or US dollars (USD) depending on your location, on each product page. TVA non applicable, article 293 B du CGI (VAT not applicable). Any reference ("compare-at") price displayed reflects the lowest price applied during the 30 days preceding the promotion, in accordance with the Omnibus Directive as transposed into the French Code de la consommation. Shipping costs, where applicable, are shown before order confirmation.

5. Orders The ordering process: (1) add product to cart, (2) review cart, (3) enter delivery and billing details, (4) select payment, (5) confirm — this final step ("order with obligation to pay") forms the contract. An order confirmation is sent to your email.

6. Payment Payment is due in full at the time of order via the payment methods shown at checkout (processed by Shopify Payments and its partners). Your order is processed once payment is confirmed.

7. Delivery See our Shipping Policy. Estimated delivery times are given at checkout. Items may be shipped from partner warehouses outside the European Union; indicative delivery windows account for this. If delivery is not made within 30 days (or the agreed date), you may cancel the order under the conditions of Article L216-6 of the Code de la consommation and obtain a full refund.

8. Right of withdrawal If you are a consumer resident in the European Union or EEA, you benefit from a statutory right of withdrawal of 14 days from receipt of your goods, without needing to give a reason, in accordance with Articles L221-18 et seq. of the Code de la consommation. This right derives from EU consumer law and applies to orders placed by EU/EEA consumers. Where a return is required, the direct cost of returning the goods is borne by the customer. Certain goods are excluded from this right under Article L221-28 of the Code de la consommation (see our Refund & Returns Policy). 9. Legal guarantees Regardless of any commercial warranty, EU/EEA consumers benefit from:

  • the legal guarantee of conformity (garantie légale de conformité, Art. L217-3 et seq. Code de la consommation) — 2 years from delivery; and
  • the guarantee against hidden defects (garantie des vices cachés, Art. 1641 et seq. Code civil) — 2 years from discovery of the defect.

Under the guarantee of conformity you may request repair or replacement, and you are exempt from proving the defect existed for 24 months after delivery. To make a claim, contact naduva.shop@outlook.com.

10. Product safety Products comply with the EU General Product Safety Regulation (GPSR, Reg. (EU) 2023/988). The economic operator established in the EU and responsible for product safety (GPSR Art. 16) is: Henry Oware, 8 bis rue Abel, 75012 Paris, France — naduva.shop@outlook.com. Report any safety concern to this address.

11. Liability We are liable for the proper performance of the contract. We are not liable for misuse of products, force majeure, or acts of third parties.

13. Dispute resolution In accordance with the provisions of the French Code de la consommation governing the mediation of consumer disputes, EU/EEA consumers have the right to use, free of charge, a consumer mediation procedure. 14. Governing law These Terms are governed by French law. This does not deprive EU consumers of the mandatory consumer protections of their country of residence within the EU.
